Duquesne police have filed criminal charges against the city’s former mayor, Nickole Nesby, stemming from a traffic stop.

According to a criminal complaint, Duquesne police Officer Ryan Drohn was in a marked car and sitting stationary on Commonwealth Avenue at State Route 837 at 12:08 a.m. Aug. 7 waiting for a traffic light to turn green.

The complaint states that a black GMC SUV negotiated a wide turn off of 837 and entered his eastbound lane. Drohn wrote that the vehicle nearly struck the front driver side panel of his patrol vehicle “before turning abruptly back into the westbound lane of Commonwealth Avenue.”

According to the complaint, Drohn estimates that the SUV missed the cruiser by less than a foot. The complaint states that he turned the patrol car around and followed the SUV. He “observed it to be drifting over the double yellow line by approximately a half tire width for approximately two seconds with ongoing traffic in the eastbound lane.”

After another abrupt turn, Drohn utilized the emergency lights and pulled the vehicle over for a traffic stop at Overland Avenue and Commonwealth.

At the stop, Drohn identified Nesby, 53, of Duquesne as the driver, the complaint states. Drohn wrote that Nesby “appeared to have slow sluggish responses to my questions, but did denied coming close to my vehicle.”

Nesby also denied having consumed any alcoholic beverages at that time, according to the complaint. According to the narrative, Nesby “then made a remark that she would know if she almost hit a police car because she bought them.”

Drohn and another officer reportedly conducted a field sobriety test, “and she did show signs of impairment throughout the test,” the complaint states.

Nesby is charged with driving under the influence of alcohol and a moving violation. She faces a preliminary hearing at 8:30 a.m. Sept. 24 before District Magisterial Judge Scott Schricker.

Court documents did not list an attorney for Nesby.

Nesby served as Duquesne’s mayor from 2018 to 2022. She lost her re-election bid to current Mayor R. Scott Adams by a sizeable margin and trailed former city councilman Tim Caldwell in the primary.

According to BallotPedia, Nesby, a Democrat, had announced a run for election to the Pennsylvania State Senate to represent District 45 this year; however, she was not on the ballot for the primary.
